Information contained in EOS Press Release – March 2006 – are only partial and do not give a complete and exact description of reality of facts.
In a press release published on its own Italian web-site and in a newsletter sent to all companies registered in its mailing list, CRP has informed its own product Windform XT, has some patent pending applications in Italy, Europe and United States of America, that is true.
CRP, gave the patent application numbers too, which has immediately been informed to be able to supply copies of these documents, when required, and to whom is interested in these documents.
Furthermore CRP has also informed that it has already begun some judicial proceedings in defense of its own patent pending applications.
This is true because CRP has begun these proceedings in Italy.
The District Court of Munich has decided so far that only some of the expressions inside the press release (later modified by CRP) are not correct in respect of the German law (referring only to Germany), in regards because the patent has not been already published and granted.
As everybody knows the publication of a patent application is automatically done after 18 months from the priority date: within a few days also CRP patent applications will be published.
Moreover, in some countries (as Italy) the proceedings in defense of patent application can be started also before this publication and the patent is granted.
Referring to patent applications mentioned by EOS, and their contents, which is different from CRP patent applications contents in any case, will be deeply analysed by CRP. In any case, these patent applications – that were not published at the moment of CRP patent applications deposit- have absolutely no influence on CRP applications validity, and in fact they were not nominated in the search report of European Patent Office on CRP patent applications.
